Terms of Service

Effective date: August 1, 2026

These Terms govern website use. They do not replace the separate photography services agreement, model release, invoice, or other contract used when a client books services.

1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the website operated by Colorado Springs Photography Studio at [WEBSITE URL] (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Informational Purpose; No Booking or Contract
The Site provides information about our photography business and allows visitors to submit inquiries. Submitting a contact form, requesting a date, or receiving a response does not reserve a session, guarantee availability, create a photographer-client relationship, or form a binding contract. Services are booked only after we expressly accept the engagement and any required agreement, retainer, or payment has been completed.

Website descriptions, availability, packages, pricing, promotions, and other information may change at any time. Any proposal or photography services agreement we provide will control if it conflicts with information on the Site or these Terms regarding the purchased services.

3. Permitted Use
You may use the Site only for lawful, personal, and legitimate business-inquiry purposes. You may not:
Use the Site in violation of law or the rights of another person.
Attempt to gain unauthorized access to the Site, accounts, servers, or networks.
Introduce malware, scrape or harvest information, overload the Site, or interfere with its operation.
Use automated systems to access the Site except as permitted by us in writing or by standard search-engine indexing practices.
Impersonate another person, submit false or misleading information, or use the Site to transmit unlawful, abusive, or infringing material.
Copy, reproduce, modify, distribute, sell, license, or exploit Site content except as expressly permitted by these Terms or applicable law.

4. Intellectual Property
The Site and its content—including photographs, images, graphics, logos, branding, text, layouts, and design—are owned by or licensed to Colorado Springs Photography Studio and are protected by copyright, trademark, and other laws. No ownership rights are transferred to you.
You may view the Site and make a temporary copy of pages for your personal, noncommercial use. You may not download, reproduce, edit, publish, display, distribute, create derivative works from, remove notices from, or use our photographs or other content for commercial purposes without prior written permission. Rights in client photographs and delivered images are governed by the applicable photography agreement and license, not these Terms.

5. Information You Submit
You represent that information you submit through the Site is accurate, that you have the right to provide it, and that doing so does not violate law or another person's rights. You grant us permission to use submitted information as reasonably necessary to respond to you, operate our business, and provide requested information or services, subject to our Privacy Policy.

Do not submit confidential, highly sensitive, illegal, or infringing material through a general contact form. An inquiry is not confidential merely because it is submitted through the Site.

6. Electronic Communications
When you contact us electronically, you consent to receive responsive communications by email, telephone, or text at the contact information you provide, consistent with your request and applicable law. Consent to receive marketing communications is not a condition of purchasing services. You may opt out of promotional emails using the unsubscribe link provided.

7. Third-Party Links and Services
The Site may contain links to or integrations with third-party websites, platforms, or services. We do not control and are not responsible for their availability, content, terms, privacy practices, or security. Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES RELATING TO THE SITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Nothing on the Site is legal, tax, medical, or other professional advice. Photography results, deliverables, scheduling, fees, cancellations, and remedies are governed by the applicable written photography agreement.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORADO SPRINGS PHOTOGRAPHY STUDIO AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US, IF ANY, SPECIFICALLY FOR ACCESS TO THE SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Colorado Springs Photography Studio and its owners, members, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or your violation of another person's rights.

11. Suspension and Termination
We may restrict or terminate access to the Site, with or without notice, if we reasonably believe you violated these Terms, created risk or legal exposure, or interfered with the Site. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing-law provisions.

12. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Subject to applicable consumer-protection law and any controlling written agreement between you and us, exclusive venue for disputes arising from these Terms or the Site will lie in the state or federal courts serving El Paso County, Colorado, and you consent to their jurisdiction.

13. Changes to These Terms
We may revise these Terms from time to time by posting an updated version on the Site and changing the effective date. Changes apply prospectively when posted unless otherwise stated. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

14. General Terms
If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, sale, or transfer of assets. These Terms and the Privacy Policy constitute the entire agreement concerning use of the Site, but do not replace a separate photography services agreement.
